Captain Cullet Terms of Use

By using any internet website or social media platform operated by Saint-Gobain Containers, Inc. ("Company"), including but not limited to www.captaincullet.com, and related pages appearing on Facebook or Twitter and featuring the Captain Cullet character (each a "Site" and collectively referred to herein as "Sites"), you agree to the following Terms of Use ("Terms"):

Ownership of Captain Cullet. The Captain Cullet character and its likeness are the sole property of the Company, and you have no right to use them in any commercial way outside the Sites. Any use you do make must be at the request of the Company and, except for effects that directly and primarily benefit the Company, noncommercial.
Ownership of Submitted Materials. By submitting any photographs, audio, video, or other content ("Submitted Materials") to a Site, you hereby agree that you are the owner of, or have written evidence of the right to upload, the Submitted Materials on these Terms. You also promise that neither your upload nor the reasonably intended use of the Submitted Materials will violate any right of any third party. If it does violate any right of a third party, you will legally defend the Company and make the Company whole for related any damage or loss it incurs.
Grant of Exclusive License. By uploading Submitted Materials to a Site, you grant an exclusive license ("License") to Company to use the Submitted Materials for the Company’s promotional and marketing purposes, provided however, that any Submitted Materials containing the Company’s intellectual property will become property of the Company when submitted, and no license will be needed for any use of those Submitted Materials by Company.
Right to Remove and/or Edit Submitted Materials. Company reserves the right, at any time and for any reason in its sole discretion, to remove Submitted Materials from a Site and/or to edit, change, crop, and truncate Submitted Materials as it feels appropriate.
